Privacy policy

The policy:

This policy sets out what personal data we process when you visit this website, on what legal basis, how long we keep it and what rights you have. It applies to smart-media.io and to no other channel.

Controller

The controller for the processing described here is smart-media solutions llc, registered at 147 front street, suite e30, brooklyn, ny 11201. Requests relating to your personal data can be made through our contact form.

Server logs

Our servers record each request in an access log. A log entry contains the IP address the request came from, the page requested, the time, the browser's user-agent string and the referring page. IP addresses are personal data under the GDPR and are treated as such.

These logs are kept in order to operate and secure the site, on the basis of our legitimate interest under Art. 6(1)(f) GDPR. They are not used to build a profile, are not combined with other data, are deleted on a rolling basis and are disclosed to third parties only where the law requires it.

Cookies

We set two cookies of our own: one to maintain your session and carry the token that protects our forms, and one to record your consent choices. Neither identifies you to a third party and neither is used to track you across sites. One further cookie, set by Google, is placed only if you consent to third-party spam protection.

Every cookie this site can set is listed with its purpose, lifetime, provider and consent status, alongside the controls to change your choices.

Analytics and advertising

We sell no advertising space, run no advertising code and have no advertising partners.

Visits are counted by software we host on our own servers. It sets no cookie and stores no identifier in your browser. It records the page requested, the referring page, your browser and device type, and an approximate location derived from your IP address at country, region and usually city level. The IP address is used to derive that location and to group the requests belonging to a single visit, and is then discarded rather than stored. No third-party analytics service receives your data.

This measurement does not require consent under Art. 5(3) of the ePrivacy Directive or §165(3) TKG 2021, as nothing is stored on or read from your device. The processing itself rests on our legitimate interest in knowing which pages are read, under Art. 6(1)(f) GDPR. Our balancing assessment is available on request.

Visitors whose browser sends a "Do Not Track" signal are not counted. You may also object to this processing under Art. 21 GDPR by contacting us.

Third party services

One third party may receive data about you, and only with your consent: Google, through the reCAPTCHA challenge that protects our forms from automated abuse. Where you consent, Google receives your IP address and information about your browser and processes both under its own privacy policy, which we do not control. If you decline, the challenge is not loaded and our forms fall back to spam checks that run on our own servers. Declining does not prevent you from contacting us.

Cookies can also be managed in your browser settings. The relevant instructions are published by each browser vendor.

Your rights

Under the GDPR you have the right to access your personal data (Art. 15), to have it rectified (Art. 16) or erased (Art. 17), to restrict its processing (Art. 18), to receive it in a portable form (Art. 20) and to object to processing based on our legitimate interests (Art. 21).

Requests can be made through our contact form and are answered within one month, in line with Art. 12(3) GDPR. You also have the right to lodge a complaint with a supervisory authority.

Consent

Using this website is not treated as consent to anything. Under Art. 4(11) GDPR, consent is a freely given, specific, informed and unambiguous indication of your wishes, given by a statement or a clear affirmative action.

Most of the processing described here does not rest on consent: operating the site and keeping access logs rest on our legitimate interests, and answering a message rests on the fact that you sent it. Consent is required only for the third-party spam protection described above, and it can be refused without any loss of function.

You can review and change your choices at any time on the cookies page. Withdrawing consent is as simple as giving it and takes effect immediately, but does not affect processing carried out beforehand.

Children's information

This website is not directed at children, and we do not knowingly collect personal data from children under the age of 13. If you believe that a child has provided such data, please contact us and we will delete it.

Scope

This policy covers this website only. It does not apply to data collected offline or through other channels, nor to websites operated by third parties that we link to.
